This work aims to analyze and suggest regulatory aspects that can help the full introduction of the cogenerator, in the context of the structural change through wich the Brazilian Electric Sector has been passing. In order to do this, we took as base generic questions such as the adaptation of the new legal directives to guarantee the good attendance and supply of generated electric energy, and propose mechanisms to facilitate the choice regarding the agent that provides to the consumer the best conditions of quality and price. As a result of this, there is a need to emphasize the fact that this new Model of the Electric Sector must contemplate all the forms of electric generation, including the one from the biomass cogeneration, as is the case of the one used by the sugarcane sector. The specific regulation to support the cogeneration must assure to the cogenerator guarantees both regarding the implantation of its unit, and the sale of extra generated energy in the competitive market.
